We support enhanced accountability and transparency in the bankruptcy management
process through the following changes:
- Implementation of a more transparent selection process
We advocate engaging in competitive bidding and restoring
debtor input, as recommended by the Southern District of New York.
- Creation of a defined fee structure to ensure fiduciary
responsibility
When a claims agent is brought into the process, it should
be clear exactly what tasks will be performed and at what costs.
- Establishment of ethical standards covering the way claims
agents sell their services
As private companies aiding the functions of a federal
office, this sector cannot afford the appearance of impropriety. Improved oversight
of the industry would ensure that ethical standards are defined and applied.
